1. Scope and Acceptance of Terms

1.1

These Terms & Conditions ("Terms") govern your use of the website www.comehideout.com ("Website") and your purchase of any services offered by The Hideout, including the camp experience package and any future add-on services.

1.2

By accessing or using the Website, and/or by placing a booking, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Website or purchase any services.

1.3

These Terms may be updated from time to time. The most current version will always be available on this page with the "Last Updated" date shown above. Continued use of the Website or services after changes constitutes acceptance of the updated Terms.

1.4

These Terms apply in addition to our Privacy Policy and Cookie Policy, which are incorporated by reference. Please review those documents carefully.

1.5

Participation in any Experience (as defined in Section 2) is additionally subject to the participant's execution of a separate Assumption of Risk and Waiver of Liability document ("Waiver"), as described in Section 12.6. The Waiver is supplementary to these Terms.

2. Services

2.1

The Hideout offers a camp experience package ("Experience"), which is a curated in-person event that includes — as described on the Website at the time of booking:

  • Accommodations (depending on the selected ticket option)

  • Meals (as specified in the package description)

  • Access to all activities and experiences offered as part of the event

2.2

The specific inclusions for each Experience are detailed on the relevant booking page. The description at the time of booking forms part of the contract between you and The Hideout.

2.3

In the future, optional add-on services may be offered in addition to the base package. Any add-ons will be clearly described and priced separately, and purchase of add-ons will be subject to these Terms.

2.4

The Hideout does not offer subscription plans or recurring memberships. Each booking is for a single Experience or event.

2.5

Users cannot create accounts on the Website. There are no user-generated content features — you cannot upload, post, or publish content through the Website.

3. Conclusion of Contract (Booking)

3.1

By completing a booking and submitting payment, you ("the Participant") confirm that:

  • You are of legal age (minimum 21 years old, as specified in Section 5)

  • You have the legal capacity to enter into a binding contract under applicable law

  • The information you have provided is accurate and complete

3.2

A booking becomes legally binding upon receipt of full payment by The Hideout. Payment is processed through Stripe via booking forms hosted by Tally.so.

3.3

Once payment has been successfully received, The Hideout will send a confirmation email to the email address provided during booking. This confirmation constitutes acceptance of your booking and formation of the contract.

3.4

If a booking is made on behalf of or for multiple participants, the person making the booking ("the Lead Booker") is responsible for:

  • Ensuring that all named participants are informed of and agree to these Terms

  • Providing accurate personal information for each participant

  • Ensuring all participants meet the eligibility and participation requirements set out in
    Section 5

  • Ensuring all participants execute the required Waiver (Section 12.6) prior to participation

The Lead Booker accepts liability for the obligations of all participants included in the booking.

  • Payment is not received or is reversed

4.3

Payments are processed securely through Stripe. The Hideout does not store your full payment card details. All payment data is handled directly by Stripe in a PCI-DSS compliant environment. For more information, see Stripe's Privacy Policy.

4.4

If payment is not received within the timeframe specified during the booking process, The Hideout reserves the right to cancel the booking without further notice.

The Hideout reserves the right to reject a transfer if the proposed new participant does not meet the eligibility or participation requirements set out in Section 5.

In cases of cancellation due to the Participant's breach of these Terms or non-payment, no refund will be issued.

In such cases:

  • Participants will be informed as soon as reasonably possible, and no later than 14 days before the event start date

  • Participants will be offered either:

    • A full refund of the booking price, or

    • A transfer to a future event (subject to availability)

8.3 Changes to the Experience

The Hideout reserves the right to make reasonable changes to the Experience program, including changes to specific activities, schedules, venues, or service providers, where necessary due to operational, safety, or logistical reasons.

Where changes are material (e.g., change of dates or location), The Hideout will inform participants as soon as possible and offer the option to:

  • Accept the changes, or

  • Cancel for a full refund

Minor changes to the program (e.g., activity schedule adjustments, substitute instructors) do not constitute grounds for cancellation or refund.

9. Force Majeure (Event Cancellation or Interruption Beyond Our Control)

9.1

The Experience may be cancelled, postponed, or interrupted due to circumstances beyond The Hideout's reasonable control ("Force Majeure"), including but not limited to:

  • Natural disasters, severe weather, or environmental hazards

  • Issue a refund for the portion of the Experience not yet delivered

By attending the Experience, participants acknowledge and agree that photographs, videos, audio recordings, and other media may be captured during the event by The Hideout, its staff, or designated photographers/videographers.

10.2

If you do not wish to appear in media, please inform The Hideout staff in writing before or at the start of the event. While we will make reasonable efforts to honor such requests, we cannot guarantee complete exclusion from group photos or wide-angle shots taken in shared spaces.

10.5

Your personal data (e.g., full name) will not be publicly disclosed in connection with published media without your explicit consent. For more details on how we handle your data, please see our Privacy Policy.

11. Email Communications

11.1

By completing a booking, participants agree that The Hideout may use the email address provided to send essential communications related to the booking and the Experience, including:

  • Booking confirmations and receipts

  • Pre-event information and logistics

  • Important updates or changes to the Experience

  • Post-event follow-up (e.g., feedback requests)

These communications are transactional and are necessary for the performance of the contract. They do not require separate marketing consent.

11.2

Marketing and promotional emails (e.g., newsletters, future event announcements) will only be sent if the participant has explicitly opted in to receive them. Participants may unsubscribe from marketing emails at any time by:

11.3

Email addresses will not be shared with or sold to third parties for marketing purposes.

12. Liability and Assumption of Risk

12.1 The Hideout's Responsibility

The Hideout is responsible for:

  • The proper organization and delivery of the Experience as described at the time of booking

  • Providing the services included in the booking (accommodations, meals, activities) as described, or suitable alternatives where necessary

  • Ensuring that reasonable safety measures are in place during the Experience

12.2 Limitation of Liability

Participation in the Experience involves inherent risks, including but not limited to risks associated with physical activities, outdoor environments, group settings, travel, and varying weather and terrain conditions. By booking and participating, you acknowledge that you understand and voluntarily accept these inherent risks.

The Hideout's liability is limited as follows:

  • The Hideout is not liable for personal injury, illness, loss, or damage to property unless caused directly by The Hideout's gross negligence (grobe Fahrlässigkeit) or intentional misconduct (Vorsatz).

  • Liability for slight negligence (leichte Fahrlässigkeit) is excluded, except in cases involving injury to life, body, or health, or the breach of a material contractual obligation (Kardinalpflicht). In such cases, liability is limited to the foreseeable, typically occurring damage.

  • The Hideout's total aggregate liability for any claim or series of related claims arising from a single booking shall not exceed the total amount paid by the Participant for that booking.

12.3 Personal Belongings

Participants are solely responsible for the safety and security of their personal belongings at all times during the Experience. The Hideout is not liable for loss, theft, or damage to personal property.

12.4 Third-Party Services and External Factors

The Hideout is not responsible for disruptions, delays, or failures caused by:

  • External service providers (e.g., transportation companies, venue operators, catering partners)

  • Travel delays or cancellations

  • Force Majeure events (as defined in Section 9)

  • Participants' own actions, negligence, or failure to follow instructions

12.5 Health and Insurance

Participants are strongly advised to arrange their own:

  • Travel insurance (including cancellation coverage)

  • Health/medical insurance valid for the duration and location of the Experience

  • Personal liability insurance

The Hideout does not provide insurance coverage for participants.

12.6 Assumption of Risk and Waiver of Liability

Prior to participation in the Experience, all participants will be required to read and sign a separate Assumption of Risk and Waiver of Liability document ("Waiver").

The Waiver outlines the specific risks inherent to the activities included in the Experience and requires the participant's acknowledgment and voluntary acceptance of those risks.

Participation in the Experience is conditional upon signing the Waiver. Any participant who declines to sign the Waiver will not be permitted to participate.
In such cases:

  • If the participant notifies The Hideout of their refusal to sign the Waiver before the start of the Experience, the cancellation terms in Section 7 will apply based on the date of notification

  • If the participant refuses to sign the Waiver upon arrival at the Experience, this will be treated as a voluntary withdrawal and no refund will be issued

The Waiver is supplementary to these Terms & Conditions and does not replace the liability provisions set out in this Section 12. In the event of any conflict between the Waiver and these Terms, the provision that offers greater protection to The Hideout shall prevail, to the extent permitted by applicable law.

Important: Consistent with German law, the Waiver does not exclude or limit The Hideout's liability for:

  • Death or personal injury caused by gross negligence or intentional misconduct

  • Any other liability that cannot be excluded or limited under mandatory applicable law

13. Intellectual Property

13.1

All content on the Website — including but not limited to text, graphics, logos, images, photographs, videos, audio, design, layout, and software — is the intellectual property of The Hideout (Jen Serrat) or is used with the permission of the respective rights holder.

13.3

  • Copy, reproduce, distribute, or republish any Website content

  • Modify, create derivative works from, or reverse-engineer any Website content

13.5

All experience concepts, event formats, program designs, and branded materials created by The Hideout are proprietary. Unauthorized reproduction, imitation, or use is prohibited.

14. Indemnification

14.1

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless The Hideout (Jen Serrat), and any staff, contractors, volunteers, or service providers associated with The Hideout, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms

  • Your negligent, reckless, or unlawful conduct during the Experience

  • Any injury or damage you cause to other participants, staff, or third parties

  • Any inaccurate information you provided during the booking process

  • Your failure to disclose relevant medical conditions, allergies, or injuries as required under Section 5.2

14.2

This indemnification obligation survives the termination of the contract and the conclusion of the Experience.

15. Claims and Complaints

15.1

If any issue arises during the Experience, participants should report it immediately to a member of The Hideout staff on-site. This allows us to investigate and attempt to resolve the matter during the event.

15.2

Formal claims or complaints must be submitted in writing (email to hello@comehideout.com) within one (1) month after the end of the Experience.

15.3

Claims submitted after the one-month deadline may not be considered, unless the participant can demonstrate that they were unable to submit the claim within the specified period for reasons beyond their control.

15.4

The Hideout will acknowledge receipt of a complaint within 5 business days and aims to provide a substantive response within 30 days.

16. Disclaimer

16.1

The content of the Website is provided "as is" and "as available" for general information and booking purposes.

16.2

While The Hideout makes reasonable efforts to ensure the accuracy and completeness of the information on the Website, no warranties or representations — express or implied — are made regarding:

  • The accuracy, reliability, or completeness of any Website content

  • The availability or uninterrupted operation of the Website

  • The absence of errors, viruses, or other harmful components

16.3

The Website may contain links to third-party websites for convenience or informational purposes. The Hideout does not endorse and is not responsible for the content, accuracy, or practices of any third-party sites. Visiting third-party links is at your own risk.

16.4

The Hideout does not guarantee specific outcomes or experiences from participation. Activities may vary depending on weather, group dynamics, venue conditions, and other factors.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms, and any dispute arising out of or in connection with them (including non-contractual disputes), are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

17.2 Jurisdiction

Where permitted by law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Berlin, Germany.

For consumers (Verbraucher) residing in the European Union, this does not affect your right to bring proceedings in the courts of your place of residence, as provided by mandatory EU consumer protection laws.

17.3 Online Dispute Resolution (EU)

In accordance with Regulation (EU) No 524/2013, the European Commission provides an Online Dispute Resolution (ODR) platform for consumers:

The Hideout's email address for the purposes of the ODR platform is: hello@comehideout.com

Note: The Hideout is not obligated to participate in dispute resolution proceedings before a consumer arbitration board, and does not currently commit to doing so. We will, however, consider participation on a case-by-case basis.

18. Right of Withdrawal (Widerrufsrecht) — EU Consumers

18.1

Under EU consumer protection law (Directive 2011/83/EU, as implemented in German law under §§312g, 355 BGB), consumers who enter into a contract at a distance (e.g., online) generally have a 14-day right of withdrawal ("cooling-off period").

18.2

However, this right of withdrawal does not apply to contracts for the provision of leisure services that specify a specific date or period of performance (§312g Abs. 2 Nr. 9 BGB).

Since The Hideout's Experience takes place on a specific date, the statutory right of withdrawal is excluded under this exception.

18.3

By completing a booking, you acknowledge and agree that:

  • The Experience is a leisure service with a specific date of performance

  • The statutory right of withdrawal does not apply to your booking

  • The cancellation terms set out in Section 7 of these Terms apply instead

18.4

For the avoidance of doubt, the cancellation rights described in Section 7 are contractual cancellation rights offered by The Hideout as a goodwill measure, and are separate from and in addition to any mandatory statutory rights that may apply.

19. Severability

19.1

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms.

19.2

The remaining provisions shall continue in full force and effect.

19.3

The invalid provision shall be replaced by a valid provision that most closely reflects the original commercial intent of the parties.

20. Entire Agreement

20.1

These Terms, together with the Privacy PolicyCookie Policy, and the Waiver (Section 12.6), constitute the entire agreement between you and The Hideout regarding your use of the Website and the purchase and participation in services.

20.2

No prior written or oral agreements, representations, or understandings between the parties shall have any effect.

20.3

Any amendment or waiver of these Terms must be made in writing and confirmed by The Hideout.
